The learned counsel appearing for the petitioner states that application for grant of development permission and I.O.D. has been now rejected by the Mumbai Municipal Corporation. If that be so, remedy of the petitioner is to prefer an appeal under Section 47 of the Maharashtra Regional and Town Planning Act, 1966. In view of the availability of the said remedy, we decline to entertain the Petition. Accordingly, the same is disposed of. All contentions on merits are kept open.
