Though the arbitration agreement provides for the appointment of the three arbitrators, the parties agree to appoint Mr.A.R. Pinto, Marine Claims Consultant, Post Box No.11651, Nariman Point P. Office, Nariman Point, Mumbai - 21 as the sole arbitrator. Mr.A.R. Pinto is accordingly appointed as the sole arbitrator.

There is no dispute that the arbitration agreement exists between the parties.

The Arbitration application is disposed of in the aforesaid terms. No order as to costs.
