Heard the learned Advocates appearing for the parties and the following order is passed by consent :

(i) Ms. Gulnar Mistry, Advocate is appointed as the sole Arbitrator to decide the disputes between the parties arising out of the Equipment Lease Agreement, Exhibition Agreement and Advertising Agreement dated 06-06-2013. (ii)The disclosure of Ms. Gulnar Mistry, Advocate under Section 11 (8) read with Section 12 (1) of the Arbitration and Conciliation Act, 1996 is taken on record.

arbp 909 of 2016.sxw (iii)The parties shall appear before the learned Arbitrator in his chambers, on 5 th January, 2017 at 5.00 p.m., and obtain necessary directions. (iv)The present Petition shall be treated as a Petition under Section 17 of the Act and decided by the learned Arbitrator within a period of four weeks from today.

(v) Without prejudice to the rights and contentions of the Petitioner, the Petitioner shall receive the equipments which the Respondent has agreed to handover to the Petitioner.

(vi) All contentions of the parties are kept open. (vii) The cost of arbitration shall initially be borne by the parties equally. (viii) The venue of Arbitration shall be at Mumbai. (ix)In view of this order, the above Arbitration Petition is disposed of. ( S.J.KATHAWALLA, J. ) ssp 2/2
