This chamber summons is for recalling the order date 11.01.2006 passed by the Prothonotary and Senior Master dismissing the suit under Rule 986 of the Bombay High Court (OS) Rules, 1980 for non-removal of the office objections and to restore the suit to file. For the reasons mentioned in the affidavit in support, the order dismissing the suit is recalled and the suit is restored to file. The chamber summons is disposed of accordingly. I find that the claim in the suit is less than Rs.1 crore. Therefore, the suit be transferred to the City Civil Court.
