Mr. Shah states that no affidavit in reply has been filed and relies on the order dated 21st April 2017 to state that defendant no.1 was represented in Court. Mr. Shah also states that defendant no.1 has been served copy of the plaint, notice of motion and affidavit in support and affidavit of service has been filed. Mr. Shah states that the order dated 21st April 2017 be confirmed as order in the notice of motion and notice of motion be disposed. Mr. Shah also states that for the moment he is not pressing for prayer clause - (a) (iv) and reserves his right to move the Court should the need arise.

Therefore, the order dated 21st April 2017 is confirmed as order in the notice of motion with the liberty as noted above and notice of motion accordingly disposed.
