Heard the counsels and also considered the affidavit in support. In my view, this is a fit case to grant the relief sought in prayer clauses (a) and (b) of the notice of motion. The order dated 21st March 2016 is recalled and the suit is restored to file. All interim applications stand restored.

The counsel for the applicant undertakes to comply with the directions given on 7th March 2016 within two weeks from today. Shri Kedia, counsel appearing for defendant no.2 states that within two weeks from today, they will file their affidavit of documents and also give inspection. On or before 11th November 2016, parties to exchange their respective statements of admission and denial with reasons for denial. The suit be listed on 28th November 2016.
