The Petitioner has challenged the order of the Chief 1 / 2 April 5, 2019

907-WPL-1123-19.doc Metropolitan Magistrate under Section 14 of the SARFAESI Act, 2002. Instead of invoking remedy under Section 17 of the SARFAESI Act, 2002 before the D.R.T., the Petitioner has approached this Court. Learned Counsel for the RespondentBank has pointed out that as of today the dues are in the range of Rs. 13.5 Crores.

In the circumstances, we are not inclined to entertain the Petition or grant any stay to the taking over possession of the secured asset which is scheduled to be taken on 8th April 2019 vide Notice dated 18th March 2019. 3.

Keeping remedy of the Petitioner open, we dismiss the Petition.
