In the morning session, an order was passed by consent of the parties appointing Mr. Cyrus Ardeshir as an Arbitrator to decide the disputes between the parties arising out of the Agreement dated 16-08-2007 (Exhibits A and B to the Petition). Mr. Cyrus Ardeshir, Advocate, has expressed his inability to act as an Arbitrator in the matter. In view thereof, Mr. Sarosh Bharucha, Advocate, is appointed as Arbitrator in place of Mr. Cyrus Ardeshir, Advocate. The parties shall appear before the learned Arbitrator on 30th August, 2016 at 9.30 a.m., when the learned Arbitrator shall hear the Application seeking ad-interim reliefs on behalf of the Petitioner and pass his orders on the same day. Disclosure of Mr. Sarosh Bharucha under Section 11 (8) read with Section 12 (1) of the Arbitration and Conciliation Act, 1996 is taken on record. Rest of the order passed in the morning session shall continue to be in force.
