The Company Application is taken out for condonation of delay in filing certain documents sought by the Official Liquidator in support of the Affidavit of Proof of Debt filed by the Applicant in Sharayu.

25-CAL-285-16.doc respect of her claim against the Company in liquidation. 2.

Heard Ms. Thakur in support of the Application and learned Deputy Official Liquidator. Perused the Affidavit in Support. In my view, reasons set out in the Affidavit are satisfactory. According to Ms. Thakur, there is no delay in filing these documents, in view of the fact that the notice calling for further documents was received by the Applicant only in May 2015. However, the Liquidator had taken objection on account of delay. Considering the facts of the case and statement of the Deponent, delay if any is condoned. The Company Application made absolute in terms of prayer clause (a) of the Company Application. Respondent/Liquidator is directed to proceed further with adjudication of the Applicant claim. 3.

There will be no order as to costs.

4.

Copy of the order shall not be issued till the Application is numbered. The Applicant is directed to remove all office objections within one week from today, failing which this order shall stand vacated.
