The counsel has tendered a copy of the forwarding letter with the endorsement from the Advocate for the defendants. The counsel undertakes to file an affidavit of service within one week from today.

Under Order 37 Rule-3 sub-rule 6 of the Code of Civil Procedure, at the hearing of summons for judgment if the defendant has not applied for leave to defend, the plaintiff shall be entitled to a judgment forthwith.

The defendants have not filed any leave to defend or KJ

SJ24.16-23 affidavit in reply seeking leave to defend. Nobody is present for the defendants when the matter was called out. Therefore, summons for judgment is made absolute and accordingly disposed. Suit also accordingly decreed.
