The matter was on board on 14 September 2015 when learned Counsel for the Respondent had pointed out that there was a settlement agreement between the parties in pursuance of which an amount of Rs.21,45,114/- was paid by Demand Draft by the Respondent to the Petitioner. In pursuance of the settlement agreement and payment, the Petitioner had undertaken to withdraw the winding up petition. The Petitioner was absent on the last occasion. Hence, the matter was kept today for withdrawal with direction to the Respondent to inform the Petitioner about the matter. The Petitioner has chosen to remain absent even today.

The petition is dismissed. No order as to costs. (S.C. Gupte, J.)
