Learned counsel appearing for the applicant states that the proposed defendant has been served with a copy of the chamber summons. The statement is accepted. None appeared for the proposed defendant when the matter was called out. No affidavit in 1/2
30-chs929-15 reply has been filed. Learned counsel appearing for the defendant Nos.4, 6 and 7 and defendant no.3 have no objection if this chamber summons is allowed. For the reasons recorded in the affidavit in support, the chamber summons is made absolute in terms of prayer clause (a). The amendment to be carried out within three weeks from today and the amended copy of the plaint shall be served upon all the defendants including the newly added party.

It is made clear that after carrying out the amendment, the applicant would be at liberty to seek interim reliefs against the defendant no.3 after filing separate notice of motion. (R.D. DHANUKA, J.) 2/2
