By this review petition, the petitioner has prayed for recalling of the order dated 24th April, 2013, passed by the learned designate of the Hon'ble Chief Justice under section 11 of the Arbitration & Conciliation Act, 1996, appointing a former Judge of this Court as the sole arbitrator. Learned counsel for the respondent has raised the issue of maintainability of this review petition. 2.

This Court has already held in catena of decisions that the application under section 11(6) of the Arbitration & Conciliation Act, 1996 is not before the Court and thus the review petition is not 1/2

rp37-13 maintainable. I am respectfully bound by the view taken by this Court. The review petition is accordingly not maintainable and is accordingly rejected.

There shall be no order as to costs.
