This notice of motion has been filed by defendant No.1 seeking an order and judgment directing the plaintiff to pay an alleged undisputed sum of USD 135,600/- to defendant No.1 or in the alternative for a direction to the plaintiff to deposit the aforesaid amount in this Court. When this matter was called out, none appears on behalf of any of the defendants. This notice of motion has been pending since the year 2014. It appears that defendant No.1 is not interested in prosecuting this notice of motion. In these circumstances, the notice of motion is dismissed for want of prosecution. (B.P.
