Our attention is invited to the order dated 19th November 2015 passed by the Maharashtra Housing and Area Development Authority which is Exhibit-A1 to the Petition.

The learned counsel appearing for the Petitioner on instructions seeks permission to withdraw this Petition with liberty to adopt a remedy of Second Appeal before the State Government in

sng WP-1207.16 Housing Department as stated in the order dated 19th November 2015. Accordingly, the Writ Petition is disposed of as withdrawn with liberty as prayed. 3.

If Second Appeal is preferred by the Petitioner before the State Government, the concerned Appellate Authority is bound to note that the present Writ Petition was filed in this Court on 11th April 2016 and that the same remained pending till today. 4.

All contentions on merits are kept open.
