This notice of motion is taken out pursuant to the final order in the petition having been passed on 20th August, 2014.

The father as the natural guardian of the minor child has filed a custody application in the Family Court. That has been contested by the petitioners in the above petition. This notice of motion is with regard to the transfer of the school of the child whose custody is sought in the Custody Petition filed in the Family Court. It would, therefore, be proper that Family Court which would hear all the facts and allegations of

NMS.497/15-GP.15/2014(4) the parties would decide the school of the minor child and the transfer of the school, if any.

Hence the applicant shall be entitled to make any further application with regard to the transfer of the school of the child also in the custody petition filed in the Family Court. Consequently there shall be no order in the notice of motion. No order as to costs.
