It is informed by the learned Counsel for the Plaintiff that the parties have settled their dispute in the Suit and accordingly permission is sought for withdrawal of the Commercial Summary Suit along with Summons for Judgment taken out therein. Permission is granted. The Commercial Summary Suit is accordingly disposed of as withdrawn. In view of withdrawal of Commercial Summary Suit, the Summons for Judgment does not survive. The Plaintiff shall be entitled for refund of Court Fees in accordance with law.
