The above Petition was admitted and directed to be advertised by an order dated 17th March, 2015. Pursuant thereto, the Petition has been advertised. However, the learned Advocate appearing for the Petitioner informs the Court that the Petitioner has not received any claims from any
Nitin 2 / 2 939-CP-106-2015 of the creditors / workers of the Respondent. In the meantime, the parties have settled the matter and in view thereof, the following order is passed by consent :
i.
The Respondent Company has already paid the amount as claimed in the Petition to the Petitioner. The Director of the Petitioner, who is present in Court admits having received a pay order in the sum of Rs.6,59,000/- as per the claim in the Petition. ii.
The learned Advocate appearing for the Respondent undertakes to pay a further sum of Rs.15,000/- to the Petitioner in the course of the day being interest from the date of filing of the Petition till date. The undertaking is accepted.
iii.
Upon receipt of the further amount of Rs.15,000/- by the Petitioner from the Respondent, the parties shall have no claim against each other.
iv.
Since the admission of the above Company Petition was advertised in newspapers on 2nd April, 2015, further advertisement inviting the claims from the workers / creditors is not required. v.
The above Application is accordingly disposed of. vi.
The above Petition is also accordingly disposed of as withdrawn. (S.J. KATHAWALLA, J.)
