The Petition is for leave under Clause XII of the Letters Patent. The Suit is to recovery amounts under personal guarantees. It is stated that the disbursements were made in Mumbai and the performance of the guarantee obligation was in Mumbai. A material part of the cause of action has arisen in Mumbai. Respondents Nos. 1 and 2 reside outside Mumbai. I am satisfied that with leave granted under Clause XII of the Letters Patent, this Court will have the jurisdiction to entertain and try the suit.
