Heard learned counsel for the parties.

The present writ petition has already been disposed of as per order dated 17th September, 2013 passed by the Apex Court in Special Leave Petition (Civil) No. 16136 of 2010 which reads thus :- Mr. E.R. Kumar, learned counsel instructed by M/s. Parekh & Co., appears in support of Transfered Case No. 21 of 2010 by virtue of which Writ Petition No.13 of 2010 filed in the Sikkim High Court has been transferred to this Court and numbered as Transferred Case No.21 of 2010. This petition seeks to challenge the rules and regulations framed under the Lotteries (Regulation) Act, 1998, which came into force from 2.10.1997. Because of the stay granted by the Sikkim High Court, these rules were not operative. By virtue of a stay order granted by this Court staying the order of the Sikkim High Court,those rules remained in operation. Now, learned counsel appearing in support of Transferred Case No.21 of 2010 has filed an application seeking withdrawal Ladda R.S.

920-wp-843-10-os.doc of this transfer case, meaning thereby the withdrawal of original Writ Petition No.13 of 2010 which the petitioner had filed before the Sikkim High Court.

2. MS. Radhika Gautam, instructed by Mr. Siddharth Singla, appears in Transferred Case No.29 of 2010 which arises out of Writ Petition No.843 of 2010 filed in the Bombay High Court. She is also seeking withdrawal of this transfer case, meaning thereby the withdrawal of original Writ Petition No.843 of 2010 which the petitioner had filed in the Bombay High Court.

3. Ms. Indira Jaisingh, learned Additional Solicitor General appears for the Union of India. In view of the above, we allow the withdrawal of these transferred cases. Consequently, these two writ petitions shall stand dismissed as withdrawn. In view of the withdrawal of these two writ petitions, the Lotteries (Regulation) Rules, 2010 shall operate, without any impediment, throughout India.

4. Mr. Sudhir Chandra, learned senior counsel appears in support of the intervention application. In view of the disposal of these transferred cases, the application for intervention stands dismissed. S.L.P.(C) No.16136/2010:-

In view of the withdrawal of the original writ petitions, this special leave petition filed by the State of Nagaland against an interim order dated 8.4.2010 passed by the High Court of Sikkim in Writ Petition No.13 of 2010, is no longer required to be pressed and learned counsel appearing for the State of Nagaland states that in view of this decision, he is not pressing this petition. This special leave petition stands dismissed as not pressed.

Hence, no order.
