The challenge in this petition is for setting aside the order/notice dated 11 December 1998 issued under Section 53(1) of the MRTP Act. It is stated by learned counsel for the respondent/ MCGM that the complaint in question has already been acted by the BMC. Obviously, in the aforesaid circumstances, the petition itself has become infructuous. It thus appears that for such reasons, the petitioner is also not interested in the adjudication of this petition.

It appears from the copy of the office noting that in Kiran Kawre

2-wp-2817-1999.doc pursuance of the acquisition proceedings, the respondent/ Municipal Corporation has taken over the possession of land under subject on 06 August, 2004. The office noting dated 3 November, 2006 is taken on record along with the relevant documents and marked 'X' for identification.

It is accordingly disposed off. No costs.
