CHAMBER SUMMONS NO.475 OF 2018 For reasons mentioned in the affidavit in support and Dr. Saraf, Mr. Mehta and Mr. Mohanty having no objection to the relief as prayed for in the chamber summons, the chamber summons is allowed and accordingly disposed in terms of prayer clause - (a). This order is passed without prejudice to the rights and contentions of the parties. Amendment to be carried out and copy of the amended plaint to be served within two weeks from today.

Plaintiff shall apply to the Prothonotary and Senior Master, High Court, Bombay for issuance of writ of summons latest by 5th January 2019.

Dr. Saraf, Mr. Mehta and Mr. Mohanty waive service of the writ of summons.

Time to file written statement can be considered after hearing and final disposal of the notices of motion which are listed today. Affidavit in reply to the notices of motion to be filed and copy served on or before 5th January 2019.
