The learned Counsel for the Plaintiff tenders minutes of order which records that the payment has been made by the Defendants to the Plaintiff in full and final settlement of all its claims and demands and captioned Suits shall accordingly stand disposed of as withdrawn. The consent minutes of order is taken on record and marked 'X' for identification.
In terms of the consent minutes of order, which has been executed between the Plaintiff and the Defendants, the Suit No.2514 of 2000 is disposed of as withdrawn. In view of the disposal of the Suit No.2514 of 2000, the Plaintiff as well as the Defendants also seeks withdrawal of Suit No.1498 of 1992.
Accordingly, the Suit No.1498 of 1992 is also disposed of as withdrawn. There shall be no order as to costs. The Plaintiff shall be entitled to refund of Court fees in the two Suits viz. Suit Nos.1498 of 1992 and 2514 of 2000 in accordance with the Rules. Today's date shall be treated as the date of application for refund of Court fees. All pending interlocutory applications in the two Suits do not survive and are disposed of accordingly.
