Before : Shri. P. A. Jagdale, Officer on Special Duty, With Testamentary Department Date : 20th January, 2023 FOR APPROVAL OF DRAFT OF JUDGE'S ORDER:

4. TP/1106/2022 P. C. : Shri. S. U. Lakdawala Advocate for the Petitioner

1. There is a correction in a date of the draft of the Order. Petitioners have sold the property and therefore, now they are seeking ex-post facto permission for said alienation. Copy of registered sale deed is annexed with the affidavit.

2. Ld. Advocate for the Petitioner submitted that both the petitions jointly executed a sale deed (Page no. 35-48) and thereby received consideration of the sale jointly. He further submitted that considering this unique position and circumstances forced the petitioners for obtaining ex-post facto permission for alienation. He further submitted that after order there is no other formality is to be complied with as both the petitioners have received the sale proceeds. This submission is acceptable from the face of record. Furthermore, surety bond is on record.

3. Hence, draft is approved.
