---- CORAM : K.R.SHRIRAM,J DATE : 20.2.2018 P.C.:- Further to the order dated 25.1.2018, Official Liquidator has filed an affidavit dated 20.2.2018 confirming publication of notice of proposed withdrawal of the petition in `Free Press Journal' in English and in `Navshakti' in Marathi on 1.2.2018. Mr.Aithe, Company prosecutor states that they have not received any claim or objection from any party. Counsel for petitioner also states that they have not received any claim or objection.
In the circumstances, petition disposed as withdrawn. KJ
2/2 CP420.14-36 Liquidator accordingly stands discharged. Company to pay sum of Rs.50,000/- as cost to Liquidator and this amount to be paid within two weeks from today. Upon receipt of the said amount of Rs.50,000/- and the Liquidator being satisfied that the company has given donation of Rs.1,00,000/- to National Defence Fund (NDF), State Bank of India, Institutional Division, Parliament Street, New Delhi, Account No.11084239799-www.pmindia.nic.in, Liquidator to return the amount of Rs.12,00,000/- that was deposited on behalf of the company.
Mr.Aithe Company prosecutor states that Official Liquidator's Report No.398 of 2016 would not survive in view of the above order. The same accordingly stands disposed. All interim applications stand disposed.
