The suit today is for ex-parte decree because none of the defendants have filed their written statement.

When the summons for judgment came up for hearing, this Court by order dated 19.09.2005 granted unconditional leave to defend and at that stage also observed that the present suit is filed for buy-back of shares and transaction in terms of buy back arrangement is not valid in law. The plaintiffs have not contested this finding of the Court. As the transaction in the suit filed is not valid in law, the suit is not maintainable. The suit stands dismissed.
