Heard the learned counsel for the applicant. Admittedly, the applicant is carrying on business without obtaining or possessing requisite licence. Therefore, prayer made in this Notice of Motion restraining the Mumbai Municipal Corporation from prosecuting the applicant cannot acceded to. The petitioner is not entitled to carry on any business in the premises as licence has not been renewed. Accordingly, we dismiss the Notice of Motion.
