Learned counsel appearing for the petitioner states that on the basis of show cause notice dated 30th March 2016 issued under Section 33 of the Maharashtra Slum Areas (Improvement Clearance and Redevelopment) Act, 1971, an order of eviction has been passed which is the subject matter of avk 1/2

49-WP-2055-2016.doc challenge in an appeal preferred by the petitioner. He states that the appeal is pending.

In view of pendency of the appeal, he seeks permission to withdraw the petition.

Accordingly, petition is disposed of as withdrawn. All contentions on merits are kept open.
