Learned Senior Counsel Shri R.V. Desai, appearing for the Petitioner states that in view of the supervening event of this Court holding that 2 per cent quota, as also 5 per cent quota being unconstitutional, the Petitioner's claim for allotment under the 2 per cent quota has turned infructuous. The learned Counsel draws our attention to the Judgment of the Division Bench of this Court in the Writ Petition No. 1956 of 2009 in the matter of Mahendra Bakliwal v/s. State of Maharashtra dated 25/4/2017, by which Judgment, said 2 percent quota has been held to be illegal and unconstitutional. In view of the said Judgment, the Writ Petition is disposed of as having turned infractuous.
