Heard learned counsel for the petitioners. The prayer in the petition pertains to the online bid of the petitioner to purchase the unclaimed/abandoned/scrapped vehicles from respondent no.1-MCGM on 18 January, 2017 under tender dated 18 January, 2017. The prayers in the petition qua the tender have certainly become infructuous. 2.

Learned counsel for the petitioners, however, submits that a representation is made by his clients on 27 August, 2019 to the Joint Municipal Commissioner, (S.W.M), Mumbai for refund of earnest money deposit. It is stated that the representation is pending. 3.

In the above circumstances, we propose to dispose of this petition by directing the concerned Deputy Municipal Corporation to consider 1/2

6.WP1268_2017.doc and decide the representation of the petitioner as expeditiously as possible and preferably within a period of three weeks from today. If the petitioners are entitled for such refund of earnest money deposit, the same may be refunded to them within two weeks of the decision. In the event, the representation is being rejected, a reasoned order in that regard may be passed.

Disposed of in the above terms. No costs.
