This is a suit for partition. The Schedule as mentioned in Exh.'A' shows total value of movable and immovable properties as Rs.340 Lakhs. Paragraph 9 of the plaint reads as under :

"9 The Plaintiff says that for the purpose of the court fees and jurisdiction she values the reliefs in the suit at Rs.340,00,000/- being the 1/9th share of the suit property and the 1/9th share of approx. Rs.38,00,000/- (Thirty Eight lakhs), the plaintiff paying court fees of Rs.58,830/- being the ad-volerom therein."

Therefore, since the plaintiff valued her 1/9th share at Rs.38 lakhs and paid court fees of Rs.58,830/-, the suit along with pending applications be transferred to the City Civil Court, Mumbai.

The registry to forward the records and proceedings within four weeks.
