This notice of motion is for setting aside an ex-parte decree that was passed on 21st December 2011. The counsels appearing for the plaintiff and the defendant state that they have amicably resolved the matter and the defendant has agreed to pay and the plaintiff has agreed to accept a sum of Rs.65,000/- in full and final settlement of the claim of the plaintiff in the suit. The counsel for the defendant states that this amount of Rs.65,000/- will be paid within two weeks from today.
It is clarified that if this amount is not paid within two weeks, the plaintiff will be free to execute the decree as originally passed. The notice of motion accordingly stands disposed. (K.R. SHRIRAM, J.) Shraddha Talekar PS 1/1
