The challenge in this petition under Article 226 of the Constitution of India is to the order dated 7th April 2016 of suspension of license passed under Rule 6 of the Merchant Shipping (Recruitment and Placement of Seafarers) Rules, 2005. The learned counsel appearing for Union of India is right when he submits that an appeal is specifically provided against an order made under Rule 6. The said appeal is provided in Rule 7 of the said Rules.

59-WP-2004-2016.doc In view of availability of an efficacious remedy, we decline to entertain this writ petition. We dispose of the petition with liberty to the petitioner to avail of the appropriate remedy. We may note here that if the petitioner prefers an appeal, the appellate authority is bound to note that on 18th April 2016, the present petition was lodged and was prosecuted by the petitioner, which was pending till today.
All contentions on merits are kept open.
