The petition is filed pursuant to section 58(3) of the Juvenile Justice (Care and Protection of Children) Act 2015 read with 12(2) of the Adoption Regulations 2017. Mr. O. Hareendran Nambiar for Indian Council of Social Welfare is granted leave of absence in view of Emailed submissions and Covid-19 protocols.

The co-petitioner's proposes to adopt a minor presently in the care and custody of the prospective adoptive parents under section 66 of the Juvenile Justice (Care and Protection of Children) Act, 2015. The minor was born on 12 th November, 2019 and surrendered by the biological parents on 18 th December, 2019. The prospective adoptive parents are residents of Borivali and have been married for 12 years. They have no biological children. They have been directed by CARA to approach the petitioners. Prospective adoptive parents were registered under Child Adoption Resource Information and Guidance System. They have both confirmed readiness and willingness to adopt and have been made aware of the consequences of adoption.

The Adoption Committee in their report dated 30 th July, 2020 found them suitable to adopt the minor. The prospective adoptive father is a Chartered Accountant and the prospective adoptive mother is working as an Accounts writer. Clearly their income levels are acceptable. The Home Study Report supports the adoption. The prospective adoptive parents are found to be ready to adopt the child. 4.

Child Study Report is found to be satisfactory. Alternative child care plan is also disclosed. Parents of the prospective adoptive father fully support the adoption. They have undertaken to take care of the 2/3

child in the absence of their prospective adoptive parents during working hours.

I am of the view that the petition is liable to be allowed and pass the following order:

(i) Petition is allowed in terms of prayer clause (a) to (d) both inclusive.

(ii) The child shall not be offered for further adoption. (iii) Judge's order is signed separately. Undertakings are accepted. (iv) Petition is disposed in the above terms.
