In our view, petition can be conveniently disposed of by directing the Commissioner to consider the representation of the Petitioners. It is clarified that representation may be given within a week and within one week thereafter, the Commissioner may decide the representation of the Petitioners on merits and in accordance with law. Mr. P. K. Dhakephalkar, learned senior counsel submits that at this stage, Petitioners do not press validity of the circular, which has been issued, and reserve their right to challenge said circular in future, if necessary.
