Heard learned Senior Counsel Dr.V. Tulzapurkar for the petitioner and learned Counsel Mr.Hiren Kamod for the respondent. 2.

This petition is filed under Clause XIV of the Letters Patent of the High Court of Bombay for combining the cause of action of infringement of trade mark and passing off the same. 3.

The learned Counsel Mr.Hiren Kamod for the respondent submits that they have no objection if petition is allowed in terms of prayer clause (a). Hence, the petition is disposed of in terms of prayer clause (a) which reads thus:- "(a) that leave be granted to the Petitioner under clause XIV of the Letters Patent of this Hon'ble Court to join together the

psv 10-LPETN 164-17 cause of action for passing off with the cause of action of infringement of trade mark and copyright and a combined trial of the said issues be permitted in the above suit, against the Respondent."
