(204)-WP-2970-02.doc.
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
ORDINARY ORIGINAL CIVIL JURISDICTION WRIT PETITION NO.2970 OF 2002 Shri. Sandhu Pritpal Singh ..Petitioner
Versus
The State of Maharashtra and others ..Respondents Mr. Suresh Pakale, Advocate for the Petitioner. Mr. Kedar Dighe, AGP for Respondent Nos.1 & 2 - State. CORAM : PRADEEP NANDRAJOG, C.J. & N. M. JAMDAR, J.
DATE : 15th JULY, 2019 P.C.
1] The Petitioner questions Respondent No.5 being appointed as the Vice-Principal of the 3rd Respondent on the ground that said Respondent was not even qualified to be appointed as an Assistant Teacher. The second ground on which appointment is challenged is that the Petitioner was senior to Respondent No.5. On the second plea, no seniority list has been filed. On the first issue, suffice it to state that the Petitioner cannot question appointment of Respondent No.5 by filing Writ Petition in the year 2002 for the reason even as per the pleadings in the Writ Petition Respondent No.5 was appointed in the year 1986. In the year 2002, it is too late in the day to challenge the appointment of Respondent No.5. 2] The Writ Petition is dismissed.
