The learned Counsel appearing on behalf of the 1/3
Petitioners - Mr.Yadav, on instructions, seeks withdrawal of the above Writ Petition. Learned Counsel appearing for the Applicant in Chamber Summons No. 99 of 2016 Mr.V.P. Vaidya opposes the withdrawal on the ground that the filing of the Writ Petition itself was as and by way of a fraud practiced on this Court. Learned Counsel states that the above Writ Petition has been filed by a faction of the Union and by a person who has been removed from the rolls of the Union.

The aforesaid contention urged by the learned Counsel for the Applicant in the above Chamber Summons therefore discloses that there is some dispute in the Union as regards who are in fact in-charge of the management of the Union. It is not necessary for us in the present Writ Petition to go into the said aspects. The parties would be entitled to urge their respective contentions in appropriate proceedings. We, therefore, accede to the request of the learned Counsel for the Petitioners seeking withdrawal of the above Writ Petition. 3.
The above Writ Petition is accordingly allowed to be 2/3
withdrawn and dismissed as such.

In view of the withdrawal of the Writ Petition, the above Chamber Summons does not survive and to accordingly stand disposed of as having turned infructuous. (M.S.KARNIK, J.) (R.M.SAVANT, J.) 3/3
