By this Notice of Motion, the Applicant is seeking restoration of Appeal (L) No.492 of 2016 which suffered dismissal for non removal of office objection.

For the reasons stated in the Notice of Motion, we are of the view that there was sufficient cause for non removal of office Vishal Parekar 1/2

prod-502-nma-876-2017.doc objection within time. In the circumstances, we allow the Notice of Motion and direct the Applicant to remove the office objection within two weeks from today. We also order restoration of Appeal (L) No.492 of 2016. The same be listed before appropriate Bench. 6.

The Notice of Motion No.876 of 2017 is disposed of as such.
