By the impugned order, the suit filed by the appellant has been dismissed by the learned Single Judge by exercising powers under Rule 227 of the Bombay High Court Rules (Original Side) Rules. The suit was dismissed on the ground that the advocate for the appellant/plaintiff has not filed vakalatnma. 2.

This Appeal preferred in the year 2010 was listed before the Prothonotary and Senior Master on 22nd June 2010 when time was granted to the learned counsel for the appellant to remove office objections and get the appeal numbered. Even today, the appellant has not got the appeal numbered. It is obvious that the appellant is not interested in prosecuting the appeal. Accordingly, the Appeal is dismissed for non prosecution. No costs.
