The Petition is for leave under Clause XII of the Letters Patent. The proposed Suit challenges certain documents including those set out in paragraph 2 of the Petition. It is stated that a material part of cause of action has arisen in Mumbai. This is where all the documents were executed. The property in question is outside the jurisdiction of this Court and some of the Defendants are also outside the jurisdiction of this Court. I am satisfied that with leave granted under Clause XII of the Letters Patent, this Court will have the jurisdiction to entertain and try the suit. 2.
