The proposed Suit is a Commercial Suit for recovery of amount due under a Loan and Hypothecation Agreement and for enforcement of a security. It appears that all the Defendants are outside the jurisdiction of this Court. However, since a material part of cause of action has arisen within the jurisdiction of this Court, I am satisfied that with leave granted under Clause XII of the Letters Patent, this Court will have the necessary jurisdiction to entertain and try the suit.
