A conditional leave to defend was granted in the present commercial suit by an order dated 20 October 2008. The order required the Defendants to deposit in this court a sum of Rs.33,98,998/-. The Defendants have failed to deposit this amount. Learned Counsel for the Plaintiff tenders a compilation of documents along with an affidavit. These documents include a certificate of non-deposit issued by the Prothonotary & Senior Master of this court on 8 November 2017. Considering the non-deposit, the commercial suit is decreed in terms of prayer clause (a).
