After this writ petition was extensively argued by both sides and placed for passing orders today and we expressed our disinclination to entertain it given the availability of remedies under the SARFAESI Act, Mr. Nedumpara seeks leave to withdraw the writ petition with liberty to avail the statutory remedy under section 17(1) of the SARFAESI Act. The writ petition is disposed of as withdrawn with liberty to approach the tribunal under the SARFAESI Act. All contentions of both sides are kept open.
