Mr. Nalawade, the learned G.P. appearing for the respondents, concedes that the Deputy Collector (Encroachment/Removal) and the Competent Authority has not complied with the order dated 8th July, 2010 passed by this Court in PIL No. 49 of 2008 and that he has rejected the claim of the petitioner solely on the basis of an order passed at least four years back. He requests that the matter be remanded to the Competent Authority for fresh consideration of the claim of the petitioner. Therefore, the petition is allowed in terms of prayer clause (a).
