By this Notice of Motion, ICICI Bank Limited seeks leave under Section 17 of the Presidency Towns Insolvency Act, 1909, to implead the Official Assignee, High Court, Bombay, as a party Defendant in the Transfer Original Application No.1764 of 2016 pending before the Debt Recovery Tribunal II at Mumbai, in place of the debtor who has been declared as an Insolvent on 26th May 2020.

Mr.Kesarkar, learned Deputy Official Assignee, is present in the Court and submits that the learned Official Assignee has no objection if he is impleaded in the said proceedings.

Having heard the learned Counsel and having perused the Application, the Notice of Motion is made absolute in terms of Prayer clause (a) which reads as under :
"(a) This Hon'ble Court be pleased to grant leave under Section 17 of the Presidency - Towns Insolvency Act, 1909 to implead the Official Assignee, High Court, Bombay as a party Defendant in the said Transfer Original Application No.1764 of 2016 in place of the Debtor being Defendant No.3 therein;"
