The learned senior advocate appearing for Municipal Corporation of Greater Mumbai placed on record the copy of communication dated 3 September 2015 from the Municipal Corporation to the petitioner no.1 indicating that the revised demand for the 50% of one time premium is Rs.50,22,500/- and premium towards Fungible FSI is Rs.4,95,400/- aggregating to Rs.55,17,900/-. The Municipal Corporation has called upon the petitioners to pay Rs.55,17,900.

Learned senior counsel for the Municipal Corporation states that upon payment of Rs.55,17,900/- by the

2 of 3 WP.1271.2015 petitioners to the Municipal Corporation, the Municipal Corporation shall issue No Objection Certificate for Commencement Certificate in terms of order dated 8 May 2015 of this Court in the present petition. The copy of communication dated 3 September 2015 is taken on record and marked "X" for identification.

Learned counsel for the petitioners states that the petitioners will pay the above amount of Rs.55,17,900/- within three weeks from today. Upon payment of the aforesaid amount by the petitioners to the Municipal Corporation, the Municipal Corporation shall issue No Objection Certificate for Commencement Certificate within two weeks from the receipt of amount.

With the above directions, the petition is disposed of. Compliance of the above direction shall be reported by the Municipal Corporation by filing a praecipe before this Court. (CHIEF JUSTICE) (A.K.MENON, J.) MST
