Ad-interim relief was granted on 30th April 2019, on which date defendant no.1, against whom, the relief is sought did not remain present though served. The order was extended on 7th May 2019 with reasons, and the matter was stood over to today. In paragraph 7 of the said order it is stated that "ad-interim relief as granted on 30th April 2019 to continue. Stand over to 3rd June 2019". Ms Mistry's interpretation is that ad-interim order is up to 3rd June 2019. I read it otherwise. In any event, Ms Mistry states that plaintiff has filed affidavit of one Mr. Rakesh Tambe affirmed on 3rd June 2019 confirming the service of order dated 7th May 2019 upon defendant no.1. Service has been effected on defendant no.1 on 16th May 2019. Nobody has entered appearance on behalf of defendant no.1. Meera Jadhav

2/2 nmcdl-1124-19(13).doc Therefore, ad-interim relief as granted on 30th April 2019 read with order dated 7th May 2019 to continue until further orders. As that would effectively dispose the notice of motion, notice of motion accordingly disposed.

All office objections to be removed and the suit be numbered on or before 29th June 2019, failing which, the suit will stand dismissed without further reference to the court. Writ of summons also be applied for and served on defendants by 15th July 2019, failing which suit will stand dismissed against unserved defendants, without further reference to the court.
