---- CORAM : K.R.SHRIRAM,J DATE : 14.2.2018 P.C.:- Registry has placed a report stating that pursuant to order dated 22.1.2018, respondent had published a notice of dismissal in two newspapers viz. `Free Press Journal' in English and in `Navshakti' in Marathi, on 24.1.2018 and filed affidavit of publication on 1.2.2018 and the registry has not received any affidavit opposing the dismissal of petition.

Ms.Joshi for respondent also states that she or the respondent has not received any affidavit opposing the dismissal. Statement accepted. Therefore, respondent having deposited with the Prothonotary & Senior Master, sum of Rs.4,10,813/-, petition stands dismissed.

2/2 CP666.15-901 Petitioner to take appropriate proceedings within 4 weeks from today, failing which the amount deposited to be returned to respondent. If petitioner commenced any proceedings, the amount deposited together with interest accrued, shall inure to the benefit of the proceedings to be taken by petitioner. Within 4 weeks, petitioner shall commence the proceedings and notify Prothonotary & Senior Master accordingly under advise to the advocate for respondent. Petition disposed accordingly.
