The Petition is for leave under Clause XII of the Letters Patent. The proposed Suit is a Summary Suit under Order 37 of the Code of Civil Procedure 1908 ("CPC") in the Commercial Division of this Court. The goods in question were sold and supplied in Mumbai. Payment was to be made in Mumbai. However, the proposed Defendant is outside the jurisdiction of this Court. I am satisfied that with leave granted under Clause XII of the Letters Patent, this Court will have the necessary jurisdiction to entertain and try the suit.
